Hereinafter called the VENDEE (Which expression shall mean and include all his heirs, successors, legal representatives, executors, administrators and assignees)

WHEREAS the VENDOR is the owner and possessor of the Flat no.XXXXX on XXXXXXXX floor in “XXXXXXXXX”, on C.T.S. No. XXXXXX, Aurangabad, admeasuring total XXXXX sq.ft. area (Which is more particularly described in Schedule-II hereunder). The VENDOR had purchased this flat from developer and owner- Mr.XXXXXXXXXXXXXXX of the property vide Registered Development Agreement no. XXXX, dated on 00/00/2025 at Sub Registrar office, Aurangabad.

WHEREAS Mr.XXXXXXXXXXXXXXXX had developed the property C.T.S. No. XXXXX in respect of portion XXXXXX sq.ft. of XXXXXXXXXXX, Aurangabad from Mr.XXXXXXXXXXXX vide Registered Development Agreement no. XXXX, dated on 00/00/2025 at Sub Registrar office, Aurangabad.

AND WHEREAS the developer had obtained construction permission from the Municipal Corporation, Aurangabad for the construction of flatted building named “XXXXXXXXXXXX”, on the said plot by file no. XXXXXXXX, commencement certificate no. XXXXXX, dated on 00/00/2025 which itself confirmed the payment of betterment and other charges.

AND WHEREAS the developer also executed a Deed of Declaration U/sec.2-A of the Maharashtra Apartment Ownership Act, which was executed and registered at Sr. No. XXXXX at the office of Sub-Registrar, Aurangabad on dated 00/00/2025.

AND WHEREAS VENDOR being in need of money for his legal necessities, so he desire to sale out the said property described in schedule-II and VENDEE is also willing to purchase the same and therefore, this Sale Deed of Flat is being executed on the following terms and conditions.

AND WHEREAS the VENDOR had given assurance of their title as well as rights to sale the flat. Therefore, VENDEE requested the VENDOR to sale a residential flat no. XXXXXXXXX admeasuring total XXXXX sq.ft. area on XXXXXX floor in “XXXXXXXXX”, on C.T.S. No. XXXXXXXXXXXX Aurangabad, which is specifically described in the Schedule – II hereunder. And the VENDOR agreed for the same on the following terms and conditions.

That, the VENDOR sold the flat no. XXXXXXXX on XXXXXX floor in “XXXXXXXXXXXX”, to the VENDEE for the total consideration of Rs. 00, 00, 000/- (Rupees XXXXXXXXXXXXXXX Only). The VENDEE had already paid the amount of Rs. 00,00,000/- (Rupees XXXXXXXXX Only) vide cheque no.XXXXX on dated 00/00/2025 on XXXXX Bank, Aurangabad Branch to the VENDOR as earnest money and the VENDOR hereby acknowledge the receipt of the same at the time of Agreement to Sale. And remaining amount of Rs. 00, 00, 000/- (Rupees XXXXXXXXXXX Only) vide cheque no. XXXXX on dated 00/00/2025 on XXXXXX Bank, Aurangabad Branch. As such the VENDOR received the entire consideration amount of the flat under sale, and there remained no dispute regarding the same and VENDOR acknowledges the same, only subject to cheque realization.

That, the VENDOR delivered the possession of the flat under sale to the VENDEE today only. The VENDEE can use and enjoy the said flat as an absolute owner thereof without any obstruction in his possession either by VENDOR or his legal heirs or any third party and if any obstruction is caused in the title and possession of the VENDEE, the same will be cured and defended by the VENDOR at his own costs, risk and responsibility.

That, the VENDOR hereby undertake that the flat under sale is free from all types of encumbrances and the VENDOR did not obtain any loan on the said property from any Government, semi Government or any financial institution or from any private persons. If any dues of any type are found on the flat under sale till date of execution of sale deed, the said will be paid and cleared by the VENDOR.

That, the flat under sale will be governed by the provisions of Maharashtra Apartment Ownership Act and all the terms and conditions mentioned in the deed of declaration referred above will be binding upon VENDEE.

That, the VENDOR will be liable to pay all the property taxes, taxes of either of local body or of state Govt. or any authority in respect of the flat under sale and any dues of Maharashtra State Electricity Distribution Company / electric bills of this flat under sale, till the date of execution of registered sale deed.

That, the VENDOR shall be bound to take all steps for the transferring the membership of the flat owners association in favor of VENDEE and for smooth enjoyment and transferring of rights of the property. VENDOR will help VENDEE for signing any documents, in future also, if needed, without charging any cost.

That, the VENDEE may cause any type of internal changes in the flat purchased by him but he will not cause any damage to the total RCC structure of the building or common walls etc. Similarly he will be at liberty to do interior decoration, furniture, fixtures, fittings etc. as desired by him at his own cost.

That, the VENDEE shall use the flat in such a fashion that it will not cause any obstruction or interference is caused to the occupier of the other flats in the building either because of his own conduct or conduct of his family members or any person visiting him.

That, the VENDEE became the absolute owner of the flat under sale and accordingly, he can mutate his name in the CTS record or Municipal record and the VENDOR have no any objection for the same and no separate notice is required to the VENDOR without any objection.

The VENDOR purchase said property Registered Sale Deed Day Book No. XXXXXX Dated on 00/00/2025 flat no. XXXXX admeasuring XXXX Sq.Mtr. built up area (Super built up area of flat is XXXXX Sq.mtr.) + terrace admeasuring XXXXX Sq.Mtr. on XXXXXXX floor admeasuring total area is XXXXX Sq.Mtr. which includes area of balcony, boxes and proportionate area of landing, staircase as shown in drawing attached bounded by :-

It is declared that the said property as described above is of absolute clear title owned by VENDOR is being transferred to the VENDEE.
